These Terms of Service govern your use of the Johnny X Art website and your purchase of artwork, prints, apparel, accessories, commissions, and other products or services offered through the website.
Throughout these Terms, “Johnny X Art,” “we,” “us,” and “our” refer to the operator of this website. By accessing the website, creating an account, entering the Private Gallery, or purchasing from us, you agree to these Terms.
If you do not agree with these Terms, please do not use the website.
1. OUR WEBSITE
Johnny X Art provides an online destination for discovering and purchasing original artwork, limited and open-edition art products, reproductions, wearable art, merchandise, commissioned work, and other creative works associated with Johnny X.
We reserve the right to modify, discontinue, add, or remove products, collections, features, content, or services at any time.
2. ELIGIBILITY
By using this website or placing an order, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.
You agree to provide current, complete, and accurate information when making a purchase, submitting an inquiry, requesting access to the Private Gallery, or otherwise interacting with our website.
3. PRODUCTS & ARTWORK
We make every reasonable effort to represent our artwork and products accurately.
However, colors, textures, proportions, framing, materials, and other visual characteristics may appear differently depending on your screen, device, lighting, production process, or other factors.
For reproductions and print-on-demand products, minor variations may occur between the images displayed online and the finished product.
Such normal production or display variations do not necessarily constitute defects.
Product availability is not guaranteed. We may modify or discontinue products without notice.
4. ORIGINAL ARTWORK
Original artwork is unique by nature.
Variations in texture, surface, brushwork, materials, markings, dimensions, or other characteristics may be inherent to an original work and form part of its artistic character.
Unless specifically stated otherwise, the purchase of an original artwork transfers ownership of the physical artwork only.
Purchasing an original artwork does not transfer copyright, reproduction rights, licensing rights, merchandising rights, or other intellectual property rights associated with the work.
5. COMMISSIONED ARTWORK
Commissioned artwork is created specifically for an individual collector or client and may require deposits, creative approvals, production periods, and other terms communicated before or during the commission.
Johnny X retains artistic discretion in the creation of commissioned work unless specific requirements have been expressly agreed upon in writing.
Because commissioned artwork involves creative labor, materials, planning, and time, cancellations and refunds are subject to our Return & Refund Policy.
Unless otherwise agreed in writing, commissioning an artwork does not transfer copyright or commercial reproduction rights to the client.
6. WEARABLE ART & PRINT-ON-DEMAND PRODUCTS
Certain Johnny X Art products are manufactured or fulfilled on demand after an order is placed.
Because these products are produced specifically in response to an order, availability, production times, colors, positioning of artwork, sizing, and minor manufacturing characteristics may vary.
Please carefully review product descriptions and sizing information before ordering.
Returns and refunds for these products are governed by our Return & Refund Policy.
7. PRICING & PAYMENT
All prices are displayed in the currency indicated on the website and may change without notice.
Prices may not include shipping, handling, taxes, customs duties, import charges, insurance, or other applicable fees unless expressly stated.
You agree to provide valid and accurate payment information and authorize us and our payment providers to charge the applicable amount for your order.
We reserve the right to cancel or refuse an order in the event of suspected fraud, payment problems, pricing errors, inventory issues, or other circumstances reasonably requiring cancellation.
If we cancel an order after payment has been collected, the applicable payment will be refunded according to the circumstances of the cancellation.
8. SHIPPING & DELIVERY
Shipping and delivery estimates are provided as estimates only and are not guaranteed unless expressly stated otherwise.
Johnny X Art is not responsible for delays caused by carriers, customs authorities, weather, natural events, incorrect addresses supplied by customers, or circumstances reasonably outside our control.
Customers are responsible for providing accurate shipping information.
International customers may be responsible for customs duties, taxes, brokerage fees, or other charges imposed by their country or jurisdiction.
Shipping and handling charges are separate from the purchase price unless expressly stated otherwise.
9. RETURNS & REFUNDS
Returns, exchanges, cancellations, and refunds are governed by our separate Return & Refund Policy, which forms part of these Terms.
Because many Johnny X Art products are produced on demand, certain products may be final sale or subject to restricted return eligibility.
Please review the Return & Refund Policy before purchasing.
Nothing in these Terms or our Return & Refund Policy limits rights that cannot legally be excluded under applicable consumer protection law.
10. THE PRIVATE GALLERY
Certain artwork, collections, information, offers, or experiences may be made available through the Johnny X Private Gallery.
Access may require submission of information such as your name and email address.
Private Gallery access is intended for the individual to whom access is provided. We reserve the right to modify, restrict, suspend, or discontinue Private Gallery access at our discretion.
Access to the Private Gallery does not guarantee availability of any artwork or create a right to purchase a particular work.
Artwork presented within the Private Gallery may be withdrawn, reserved, sold, or otherwise made unavailable without notice.
11. INTELLECTUAL PROPERTY
This section is particularly important to Johnny X Art.
Unless otherwise stated, all artwork, paintings, drawings, photographs, graphics, designs, product designs, written material, branding, logos, symbols, images, videos, website content, and other creative material appearing on this website are owned by or licensed to Johnny X Art and are protected by applicable intellectual property laws.
This includes the artistic works of Johnny X and the distinctive Johnny X / X visual identity.
You may not reproduce, copy, modify, distribute, publish, sell, license, create derivative works from, commercially exploit, or otherwise use our protected content without prior written permission.
Purchasing an artwork or product does not grant permission to reproduce or commercially exploit the underlying artwork.
12. ARTWORK IMAGES & REPRODUCTION
Images of artwork displayed on the website are provided for viewing and purchasing purposes.
Downloading, reproducing, printing, minting, tokenizing, merchandising, training commercial systems upon, licensing, or commercially exploiting artwork images without authorization is prohibited to the extent permitted by applicable law.
